Terms and Conditions

 
By commissioning/purchasing from © PixelCass Designs LLC, you acknowledge and agree to all of the below, unless exceptions have been agreed upon in private conversation during the commission/purchase process. 
 
  • The client may not remove my signature/watermark from my designs. I have the right to take action once I find out a breach of terms has been made. 
  • You may not claim my artwork as your own, trace, or heavily reference my work and claim it as your own. 
  • When posting my designs, you must watermark them. Whether it be with my watermark, or your own personal watermark. I spend a lot of time on my art and it would be unfair if it were stolen.
  • The artist is not responsible for printing digital media. Works will be uploaded via Shopify, Etsy, or emailed and the client can access a third party at their own expense for physical printing. 
  • Keep in mind everything is hand drawn by me and may have small imperfections. 

Seamless Designs/ PNG’s: 

  • All seamless designs include a commercial license that grants the purchaser to make up to 200 end products through their small business using © PixelCass Designs LLC. If you are a fabric print shop, leather/vinyl shop, selling sublimation transfer sheets, mailing supplies, etc you need direct approval from me to carry my files before you purchase them. Additional licensing is also required to print my designs. © PixelCass Designs. 
  • Please note that seamless designs are a digital product and no physical items will be shipped. Watermark is on the preview only and will not be included in the download.
  • For commissioned work, I, the artist, owns the rights to the original elements of the design. I will not use or resell the customer seamless pattern sent to you, however, I can alter and rearrange the original design to be used in future designs and patterns. 
  • You cannot use my files for manufacturing anywhere. They are to be used for small, handmade shops only.
  • You cannot alter my designs in any way.
  • You cannot resell my design or claim as your own. 
  • You cannot give it away for free anywhere, or share my design downloads with your friends.
  • You cannot use my design for digital products to be sold.
  • Designs cannot be used for Print On Demand services such as Redbubble, Dazzle, Printful, etc. 


Commissioned Artwork: 

  • I, the artist, has the right to refuse any commission request. 
  • I, the artist, reserves the right to cancel a commission due to poor communication or rude/inappropriate behavior. 
  • I, the artist, will not start a commission until any requested references have been received. Full payment is required before the commission will begin unless another arrangement was agreed upon beforehand. 
  • Additional payments may be required at the completion of your commission depending on if extra revisions were requested [see commission revisions].
  • Should the commissioner provide me with references of designs that don’t belong to them (ie: licensed or copyright images) they take sole responsibility for any issues, legal or otherwise, that should arise from this. 
  • I, the artist, retains all rights to the commissioned artwork, including the rights to distribution. 
  • I, the artist, retains the right to post the work to Instagram, Facebook, TikTok, Etsy, their portfolio, and any other site. These will include any reference images you have given me.
  • The client may resize/crop the commissioned artwork to create icons, wallpapers or other graphics to be used in non-commercial digital format, but the client cannot alter the artwork itself.
  • You may not resell my artwork, use it commercially, or for promotion of a commercial project, unless we have discussed and agreed on this usage. *Additional commercial rates will apply.
  • If commercial use has been agreed on, the rights to the use the design commercially will transfer to the client upon receipt of the full payment for both the work and the commercial rights. A commercial agreement will be sent separately to you if applicable.
  • For commission work, I, the artist, owns the rights to the original elements of the design. I will not use or resell the client’s commission sent to you, however, I can alter and rearrange the original design to be used in future designs and patterns.
  • Once the commission is completed, I will send the completed file(s). Once received, the file is the responsibility of the commissioner. While I, the artist, keeps copies of completed commission files, I am not responsible for replacing or resending files should they be lost. It is strongly recommend that you, the commissioner, back up the file(s) once received. Should the commissioner request a file to be re-sent, additional fees may apply. 
  • Finished work will be sent as the file type in the item description. Files are .PNG with a minimum of 300 DPI but sizing and pixels will vary depending on the design and if the client requests a specific canvas size. 
  • The client may exhibit the artist’s work online/offline without the permission of the artist as long as credit is given. Informing the artist about the exhibit is not necessary but appreciated. 

Payment: 

All prices are in USD and payments are expected to be made as such. The client is responsible for sending the correct amount, equal to the listed USD amount.
  • Displayed base prices are subject to change according to the complexity, difficulty, size, and medium of each individual piece. 
  • I require all payment up front before I begin work. No exceptions, IOUs, art trades, etc.
  • Commission payments are to be made through Shopify, Venmo addressed to @PixelCassDesigns, or PayPal addressed to PixelCassDesigns@gmail.com. Purchasing a custom commission listing from my shop is also an acceptable form of payment.
  • Gratuities are appreciated, but not expected. 

Commission Timeframe: 

Once you have paid full payment, it secures your place in my commission queue, which means you will get your commission. My average TAT is 21 business days, but it is often times sooner, depending on my workload. I am usually able to give you a time estimate as to when I can complete your commission. If for any reason it’s going to take longer to finish to your commission, I will periodically contact you with an update on my progress. 

Commission Revisions: 

I offer three revisions per commission. Any additional revisions after this are an additional 15% of your total. Because of this, it is highly recommended to send me reference photos, color pallets, and any other information that can better help me with making your vision come to life. Once I have a drawing to a certain stage, I will e-mail/message you a thumbnail and discuss it from there. Most revisions are during the drawing phase only, with the exception of very simple edits. Once a piece is in the inking or coloring stage, it is much more difficult to offer revisions, so you must be sure that you are satisfied with the thumbnail images I submit to you during the drawing phase of your commission. 

Abandoned Art: 

Clients are responsible to make sure that the artist has their correct and current contact information.
Clients are frequently updated regarding commission progress and are expected to reply within 24 hours to approve work, revisions or changes.
The artist reserves the right to interpret non-payment / non-communication for 3 days following completion or approval of work (whichever is later) as the customer’s resignation of any and all claims, rights, and/or interest in the work, at which point the artist retains full and exclusive ownership of the work. The work may then be auctioned, resold, modified, destroyed or otherwise disposed at the artist’s sole discretion. Refunds are not available for abandonment of your commission. 

Cancellation and Refunds: 

Once I, the artist, have received full payment from the client for the commission, I no longer accept cancellations or refunds. Be sure to really look through my artwork and decide if my art-style fits what you are looking for. If you are not satisfied with the piece I create for you, I will not give refunds but I will work with you on getting the piece to your satisfaction. The only exception to this is if for some reason I, the artist, am unable to finish the commission due to fault of my own, a full refund will be issued to you, the client. 
Important note: 
I, retain the rights to the commissioned artwork/s and by commissioning me, you, are allowing me to use and feature the commissioned work/s on my portfolio/ website/ social media and future published art books. 
Once you decide to commission/purchase from me, you are agreeing to the terms and conditions stated above. If you, the client, did not read the terms of services, I, the artist, will not be held responsible for your own misconception. 
I own all rights to my designs.
